The panel of three judges has ordered the court to fix a date in order to decide the fate of the petition. The petition was filed by Arora with a petition to change the order of dismissal last year by the High Court declaring Arora discharged and thereby allowed the PIL and an appeals filed by the petitioner who was discharged on February 19, 2013.

The High Court in 2014 dismissed Arora’s petition against the earlier order, thereby allowing the petitioner’s appeal against dismissal to be accepted by the High Court. This is because the High Court did not accept petitions against dismissed petitioners unless they are of such extreme importance that they pose a serious threat to the law and the administration. The High Court also did not accept petitions where the allegations of rape or assault are not proved and/or can be proven to be baseless as per the High Court.

Besides challenging the dismissal of Arora, the petitioners have also moved the High Court in the hope of quashing the order passed by the trial court which declared Arora discharged on February 19, 2013 and thus making him eligible for discharge with a sum of P40 lakh.

The petitioners have said that the Supreme Court should not have disallowed Arora’s petition against the High Court earlier while declaring him discharged. The petitioners have also challenged the conviction in the Bhola murder case. Bhola was murdered by Arora at a temple near his home at Bhola Khas Village near Udayva Kala village in Baghpat on July 7, 2007. He, along with Nandita and Vicky, killed the man in an attempt to steal a motorbike after which Arora claimed it was not his fault.

The petitioners also moved a PIL in respect of Arora’s discharge in the Bhola case with the help of former high court judge, Justice Jagdish Bhushan against the High Court and the accused.
