Kavita Nisha was one of those accused by the Delhi Police earlier for her role in the rape of Kavita and her brother.
After the arrest of Kavita Nisha and the release of her brother, a woman friend of her’s took Nisha to the police station. Soon after, she confessed that she had sexually abused Kavita and her brother (who went missing in 2009). But the Delhi Police refused to register a case against her saying that sexual abuse does not rise to a crime under the Indian Penal Code.
A woman friend of the victim said, “Nisha was in her early 20’s when she met Kavi as he took her to his room. She later decided to give her first child only because he was my neighbour. She knew Kavi and his friends as she had studied with them too. She knew the family well. However, it wasn’t for any fault of hers. The police came to know about what she had done and she was taken to jail.”
The police made it more difficult by insisting that all the family members had to be present at the arrest. The victim’s mother too, had to be present at the police station. “The police refused to register a case saying that there is no proof of her allegation so they filed only fake complaint against us,” said the victim’s mother.
On Thursday, she told the Delhi Court that the FIR will be registered against her sister and brother in the matter. She said, “I am surprised that the police filed the FIR without even investigating the matter. The police filed the complaint even after we got the victim’s statement in English and Hindi. There was no evidence. The court will decide on its suo motu.”
On Friday, the court directed her father to come on Tuesday to the court where he will be represented by the complainant’s mother. A case will be registered, she said.
According to The News Minute, “A case has been registered on the complaint of victim and her family against her sister and brother, Kavi Nisha and Sunita, for committing sexual assault between September 16 and October 1, 2014.” In a separate case, registered in the same division of the court, the complainant had accused her husband of rape.
