Jan Majhi had made a plea before the court for a day’s delay in the proceedings. In August last year, when the High Court had asked him to file the chargesheet soon, he had told the court: “I have been arrested in a false case and will do my best to clear my name.” Later, when the judge remarked: “I want you to be quiet in court, can’t you?” he replied: “No, because what really matter is if a real guilty is released or not released and who is he responsible for that.”But when the accused was freed on bail, after serving 17 months by the trial court, there were all sorts of suggestions that his detention must be based on the word of Sangeeta Kumar who had claimed he had tried to convert her husband when he had been in jail. The police has a habit of getting hold of such statements and treating them as if they were true, and chargesheet under S.P. Khan for trying to have sex with Sangeeta Kumar became an obsession of the investigating officers. It has been confirmed that Sangeeta’s father had made a statement in August that he had asked for his son’s release on bail and Sangeeta’s mother had said she had also made a statement saying that she had asked her son’s release for five days. This statement, which is also an alleged fabricated by Sangeeta on August 1, has been admitted as evidence in the chargesheet.Sangeeta is, therefore, now in jail. But there have been efforts to keep the fact of her arrest quiet because it is believed that if she had been freed on bail, it would have revealed the extent of the police’s and the BJP’s involvement in the conspiracy in the Rajasthan Assembly election and would have set a precedent for other similar cases.
