Isabela Moreno – Can She Stay While Serving As An Escritura?

Isabela Moreno, a Cuban National, is currently serving as an unpaid delegate to the 7th Congress of the Cuban National Assembly. It is expected that she will be elected to represent the island nation at the next Cuban National Assembly. However, her qualifications for the post are yet to be verified by the Cuban Government. However, given her recent marriage to another Hispanic, it is possible that the delay is related to political reasons.

The question that must be resolved is whether or not the marriage between her and Jose Maria Montoya, a Cuban National, will have any consequences on her ability to retain her U.S citizenship. There have been many cases in which dual citizens of one country have been allowed to retain their citizenship while working in another. However, the criteria for dual citizenship status is very specific. It requires an adult child to be a citizen of the country of the parent while also having the capacity to become a citizen of that same country. This is why most CEOs of major companies often have two citizenship, one in their home countries (for example: Chuck Buffet) and one in the Caribbean (such as: Carlos Ghosn, general manager of Carnival Cruise Line). In most instances, such a situation is not pertinent to Isabela Moreno.

There is no doubt that it is both an honor and responsibility to be a U.S. Citizen and to have the ability to exercise her right to vote. Nevertheless, there are certain circumstances in which this right may no longer be available, such as when she married a Cuban national. Furthermore, there may be political or legal pressures on her to change her citizenship from Cuban to US once she is seated in the Castro Government. These are all valid reasons to seek the counsel of a competent attorney who specializes in immigration law.
