Franny Arrieta: How Does “MINACAFE” Affect Mexican Immigration Status?

According to the most recent Mexican census, there are presently around 39.5 million citizens from the country of Mexico that belong to the category of Hispanic or Foreign born and out of which almost thirty-five percent of them are under the age of twenty-five years. And according to the same survey, there is a remarkable 20.5% of these individuals that have not attained a high school diploma but have instead chosen professions such as being a domestic help, working in fast food chains, sales agents, care takers at local offices, mechanics, teachers and even artists. This means that many of these individuals are lacking in education and have only a high school degree to their credit, which in turns has made them ineligible for marriage despite having the capacity to do so.

There are many reasons why some partners may not be eligible to marry despite having all the requirements to do so such as lacking nationalities, lack of education and age. The most common reason however remains that they are either under the age of 21 years and/or are not yet legally married. However, this problem has been recently addressed by the Mexican government through the initiative called the “MINACAFE” program which aims to prevent young individuals under the age of 18 years to have access to certain services and benefits such as education, work, and health insurance. For one, the intention here is to help increase the participation of the younger generation in the labor market thereby ensuring the level of competitiveness in the country’s various industries. As a consequence, as long as they possess a nationality or citizenship of Mexico, they can freely avail of the opportunity to work and study in Mexico without having to worry about nationalization or immigration issues.

So how does “MINACAFE” program work? Exactly how does it target those who fall short of meeting minimum age requirements to marry? Well, the process is quite simple. If you meet the minimum age requirement and belong to the category of Mexico citizens with Mexican nationality or citizenship and you would like to have your marriage approved; then you can simply fill out an application form. Upon approval, your marriage records will then be immediately forwarded to the Mexican government for processing and certification. In case your partner is currently residing outside of Mexico, but you are eligible to apply for a Mexican visa due to your marriage to an American national, you can still submit your application in order to secure your status.
